The department was required to develop the guidance, in consultation with the NYS Department of Health, State Education Department and NYS Office of Children and Family Services, under that law. Chapter 85 requires a prohibition on pesticide applications to playgrounds, playing and athletic field and turf at schools (effective May 18, 2011) and day care centers (effective November 14, 2010). The notice of availability of the Draft Guidance on Chapter 85 was published in the October 27, 2010 Environmental Notice Bulletin (ENB) on the DEC website, under Statewide SEQR and Other Notices. The Draft Guidance can be accessed directly from that notice. There are also links to it on the DEC home page (under "What's New") and the schools and day cares pages. Please visit www.dec.ny.gov for further information. The public comment period on the Draft Guidance ends November 29, 2010; see the ENB notice for details.
